Criminal Record Expungement

What is a Criminal Expungement?
- A criminal expungement is the sealing of your criminal record. If your criminal record is sealed, or “expunged” then an employer, landlord, or other private citizen will not be able to search and find that record.

How is an Expungement Granted?
- There are two types of expungements that are granted in the state of MN: Statutory and Non-Statutory.
- A petitioner may qualify for a Statutory expungement under MN Statute 609A.03 sub. 7 if:
- The charges were dismissed, you were found not guilty, or the case did not otherwise result in conviction.
- You were charged with a controlled substance offense-the proceedings have been dismissed and discharged.
- You were a juvenile prosecuted as an adult.
- The Board of Pardons has granted you a pardon extraordinary.
- Although it is very difficult to be granted a non-statutory expungement, it can happen in certain cases based on the court’s inherent authority to seal a record.
- A petitioner may qualify for a non-statutory expungement granted by the inherent
authority of the court if they can prove:
- They have rehabilitated themselves;
- The expungement will benefit them AND
- The benefit to them is greater than the disadvantage to the public
